Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules governing how you may use the Cloud+ platform operated by Cloud4Waste Ltd ("Cloud4Waste", "we", "our"). This AUP forms part of our Terms of Service. By using Cloud+, you agree to comply with this policy. If you do not agree, you must not use the platform.

1. Permitted Use

You may use Cloud+ solely for lawful business purposes related to waste management, machinery monitoring, waste collection marketplace activities, and associated operational functions. This includes:

  • Monitoring and managing your connected machinery and IoT gateways.
  • Managing waste collection logistics and engaging with approved waste collectors.
  • Viewing and downloading sustainability and operational reports.
  • Managing user accounts within your company hierarchy.
  • Communicating with approved counterparties through the platform's messaging features.

2. Prohibited Activities

You must not use Cloud+, directly or indirectly, to:

2a. Security & System Integrity

  • Attempt to gain unauthorised access to any part of the platform, other user accounts, or connected systems.
  • Introduce, transmit, or distribute malware, viruses, ransomware, spyware, or any other harmful code.
  • Conduct denial of service (DoS/DDoS) attacks or overload platform infrastructure.
  • Probe, scan, or test the vulnerability of any MHM system or network without prior written authorisation.
  • Circumvent or disable any security feature, authentication control, or access restriction.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the platform.

2b. Data Misuse

  • Scrape, harvest, or systematically extract data from the platform without prior written permission from MHM.
  • Upload, store, or transmit personal data of third parties without a lawful basis under UK GDPR.
  • Use or attempt to access data belonging to other users or companies on the platform.
  • Use machine telemetry or other platform data to create competing products or services.
  • Falsify, manipulate, or tamper with telemetry data or machine readings.

2c. Unlawful & Harmful Conduct

  • Use the platform for any purpose that is unlawful under English law or any applicable jurisdiction.
  • Facilitate or engage in fraudulent activity, including misrepresenting your identity, company, or capabilities.
  • Impersonate MHM, any MHM employee, or another user or company.
  • Post or transmit content that is defamatory, obscene, abusive, threatening, hateful, discriminatory, or otherwise objectionable.
  • Use the platform to engage in any activity that could violate the Modern Slavery Act 2015 or any anti-bribery legislation.

2d. Waste Management Compliance

  • Arrange or facilitate the collection or disposal of controlled waste without a valid waste carrier licence or appropriate Environment Agency permit.
  • Submit false or misleading waste records, duty of care documentation, or sustainability data through the platform.
  • Use the Marketplace to arrange disposal of hazardous waste through unapproved collectors.
  • Misrepresent the nature, quantity, or classification of waste in any job posting or agreement.

2e. Intellectual Property

  • Copy, reproduce, or distribute any MHM trademarks, logos, branding, or proprietary content without written permission.
  • Upload or share content that infringes any third-party intellectual property rights.
  • Use the platform or its outputs to build, train, or improve any AI/ML model or competing service.

2f. Account & Platform Integrity

  • Share your login credentials with unauthorised individuals or allow access beyond your authorised user count.
  • Create multiple accounts to circumvent usage limits, suspensions, or platform restrictions.
  • Exploit any bug, vulnerability, or unintended feature for personal gain or to harm others.
  • Use automated scripts, bots, or tools to access the platform in a manner that exceeds normal human usage.

3. Account Security Obligations

You are responsible for:

  • Maintaining the confidentiality of your account credentials and not sharing them with any unauthorised person.
  • Ensuring that all Authorised Users under your account are aware of and comply with this AUP.
  • Reporting any suspected security incident, data breach, or account compromise to support@cloud4waste.com immediately upon becoming aware.
  • Implementing appropriate access controls within your organisation to prevent misuse of the platform.

4. Regulatory Compliance

By using Cloud+, you represent and warrant that you will comply with all applicable laws and regulations, including but not limited to:

  • Environmental Protection Act 1990 and associated waste regulations.
  • Waste (England and Wales) Regulations 2011.
  • The Hazardous Waste (England and Wales) Regulations 2005.
  • UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018.
  • Computer Misuse Act 1990.
  • Health and Safety at Work Act 1974 and associated regulations.
  • The Bribery Act 2010 and Modern Slavery Act 2015.
  • Any applicable Environment Agency or local authority licencing requirements.

5. Machine Telemetry & Connected Devices

Where you connect machinery, gateways, or IoT devices to the platform:

  • You are responsible for ensuring that all connected devices are legally owned, properly maintained, and operated in compliance with applicable health and safety legislation.
  • You must obtain all necessary permissions from site owners or occupiers before installing telemetry equipment.
  • You must not connect devices owned by third parties without their explicit consent.
  • You are responsible for the physical security of connected gateways and ensuring they are not tampered with or misused.

6. Fair Use

You agree to use the platform in a manner that does not impose an unreasonable or disproportionate burden on our infrastructure. MHM reserves the right to throttle, limit, or suspend access where excessive usage adversely affects the platform's performance for other users. Where excessive usage is identified, we will contact you to agree reasonable limits before taking action.

7. Responsible Disclosure

If you discover a security vulnerability in the platform, we ask that you report it responsibly to security@cloud4waste.com without exploiting it. Cloud4Waste will acknowledge your report within 5 business days and work to resolve confirmed vulnerabilities promptly. We will not take legal action against individuals who report vulnerabilities in good faith and in accordance with this policy.

8. Enforcement & Consequences

Cloud4Waste reserves the right to investigate any suspected breach of this AUP. Upon confirmation of a breach, we may take any of the following actions at our sole discretion:

  • Issue a formal warning and require immediate remediation.
  • Temporarily suspend specific features or platform access pending investigation.
  • Permanently terminate your account and Subscription without refund.
  • Report the activity to relevant law enforcement or regulatory authorities, including the Information Commissioner's Office (ICO) or the Environment Agency.
  • Pursue civil legal action to recover damages, costs, and losses arising from the breach.

You acknowledge that certain breaches (e.g. hacking, data theft, illegal waste activities) may constitute criminal offences under English law and may result in prosecution.

9. Changes to This Policy

Cloud4Waste may update this AUP from time to time. We will notify you of material changes via email or in-platform notice. Continued use of the platform after notification constitutes acceptance of the updated policy.
